How it works: In order to take ownership of a property in Ontario, you need to retain (hire) a lawyer to act on your behalf. A lawyer’s role includes:
1. Searching title (ownership records) and working with the seller’s lawyer to ensure there are no legal issues with the property;
2. Acting on your behalf, and potentially on behalf of your mortgage lender, to advance the mortgage funds and secure the mortgage to the title of the property;
3. Receiving your downpayment funds to pay for the property on closing and paying your land transfer tax;
4. Meeting with you to review title to the property, sign closing documents;
